What Is WisCon?

WisCon is a free, state-run consultation program designed to help employers identify and correct workplace safety and health hazards. For construction employers in particular, WisCon offers expert guidance tailored to the realities of job sites—without the fear of penalties, citations, or enforcement actions.

Participation in WisCon is entirely separate from enforcement, meaning the focus is education and prevention, not punishment. If a job site condition changes or a new phase of work introduces additional risk, WisCon staff may work with you to find an appropriate scheduling solution when possible.

At a recent WUCA safety luncheon, Dustin Schnipke, Milwaukee Area Director for OSHA, shared updates on OSHA’s priorities, initiatives, and what they mean for our industry. More than 50 years after OSHA was established in 1970, workplace fatalities have declined from an estimated 38 per day to 15—but as Dustin emphasized, there is still work to do.

OSHA’s Current Focus
OSHA is placing renewed emphasis on working with small businesses, listening to stakeholders, and strengthening partnerships and collaboration. A key shift is the increased use of compliance assistance—helping employers identify and fix hazards before injuries occur.

Cooperative Programs (Highly Encouraged)
OSHA continues to promote voluntary programs that support safety improvement at every stage:

On-Site Consultation (WISCON) – a confidential, no-cost service strongly recommended for contractors
Safety & Health Achievement Recognition Program (SHARP)

The 2025 list is out, and while many industries should pay attention, underground and utility contractors face unique risks that line up with several of the top violations. Here’s a breakdown of the most relevant items, along with trenching and excavation hazards that continue to be a top focus for OSHA inspectors.

Fall Protection – General Requirements (1926.501)
Falls remain the #1 most cited violation. For underground contractors, the risks aren’t always rooftops—they include falls around trenches, vaults, manholes, ladders, and uneven ground. Proper guardrails, harnesses, and safe working surfaces are essential.
Hazard Communication (1910.1200)
Chemicals are everywhere on utility jobs: fuels, solvents, coatings, and even the contents of pipes. Employers must ensure proper labeling, Safety Data Sheets (SDS), and worker training to stay compliant.
Ladders (1926.1053)

Thorough Equipment Inspection

Before any lifting operation, inspect all rigging equipment meticulously:

Slings and Hardware: Ensure they are free from defects and have legible identification tags.
Nylon Slings : Look for tears, frayed threads, or knots, which can compromise strength.
Chain Slings: Check for elongation and ensure hammerlocks pivot correctly.
Hooks (e.g., Crosby Hooks): Inspect for visible bends, twists, or open clips. Ensure the load point is centered to prevent latch failure.

If any equipment lacks proper identification or shows signs of wear, remove it from service immediately. Some items can be repaired and retagged, but always assess the cost-effectiveness and safety implications of repairs versus replacements.

Accurate Load Weight Assessment

WUCA maintains a strong and collaborative relationship with Operating Engineers Local Union 139 and Wisconsin Laborers Local 113 through established collective bargaining agreements. These agreements ensure fair wages, safe working conditions, and comprehensive benefits for union members while promoting a harmonious and productive work environment. By partnering with these unions, WUCA supports skilled labor and fosters mutual growth, stability, and shared success within the construction industry in Wisconsin.

As a result of WUCA's collective bargaining agreements, contractors are obligated to contribute to the Issues Improvement Program or the Contractor Administration Fund an hourly rate as defined by the agreement. These contributions support industry-related initiatives, enhance labor-management relations, and fund the administration of the collective bargaining agreements, ensuring their effective implementation and ongoing development. WUCA Members pay IIP Only, Non Members Pay both IIP and CAF. Please feel free to use the table on the back side of this flier for your calculations.

Due: Payments are due monthly, by the 15th of the month following the payment period.

Industry Improvement Program (IIP) - All
$0.18 per hour an employee works (straight or overtime)
Contract Administrative Fund (CAF) - Non-WUCA Members Only
$0.30 per hour an employee works (straight or overtime)

Late Fees:

Laborers 113- After employer is made aware of delinquent payments in writing, damages may be calculated as follows: An additional 20% of delinquent payment shall be applied, as well as monthly interest accrual on unpaid and delinquent balances. If delinquency is deferred to legal counsel for collection, attorney’s fees and other costs and expenses reasonably arising in connection to the collection may be added.
Operators 139-Employer will be assessed, and agree to pay, $2.00 per employee for each thirty day period of delinquency. Employers may also be charged damages and costs for the purpose of enforcing rules, including audit, appropriate legal, equitable and administrative relieve without the need for grievance or arbitration.
